Regulations

Babyuniverse.pl online store, operating at http://www.babyuniverse.pl, is run by the company MINDON Łukasz Kolanowski with its registered office at Teofila Mateckiego 22/23, 60-689 Poznań, entered into the Central Register and Information on Economic Activity conducted by the minister competent for economy, NIP 9720951969, REGON 302430965.

The provisions of the Regulations are not intended to exclude or limit any consumer rights conferred on them by mandatory provisions of law and any possible doubts should be explained for the benefit of the consumer.

DEFINITIONS

Business day - it is one day from Monday to Friday, excluding public holidays;

Registration form - a form available in the Store that allows you to create an Account. Registration in the www.babyuniverse.pl online store requires the User's consent to the processing of his Personal Data to the extent and for the purpose necessary to use the services provided by MindON Łukasz Kolanowski as part of the Store, including the transfer of Personal Data to third parties with the help of which MindON Łukasz Kolanowski provides services as part of the Store and the provision of this data is necessary for the proper performance of the service. Consent is given by clicking the checkbox available on the Store's website.

Order form - an interactive form available in the Store that allows you to place an Order, in particular by adding Products to the electronic basket and defining the terms of the Sales Agreement, including the method of delivery and payment;

Client - a person with full legal capacity, and in cases provided for by generally applicable regulations also a natural person with limited legal capacity; a legal person or an organizational unit without legal personality, which the law grants legal capacity, making purchases in the Store;

Civil Code - the Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended);

Consumer - a person within the meaning of art. 221 of the Civil Code;

Account - the Store space assigned to a given Customer after registration at http://www.babyuniverse.pl, secured with a login and password, enabling the saving and storage of information about the Customer's shipping data, presenting the history and status of orders;

Regulations - these regulations of the babyuniverse.pl online store;

Registration - a one-time activity consisting in creating an Account by the Customer, made using the registration form provided by the Seller on the Store's website;

Store - an online store run by Mindon Łukasz Kolanowski operating at: http://www.babyuniverse.pl, selling products via the Internet;

Seller - the company Mindon Łukasz Kolanowski with its registered office at Teofila Mateckiego 22/23, 60-689 Poznań, entered into the Central Register and Information on Economic Activity kept by the minister competent for economy, NIP 9720951969, REGON 302430965;

Product - a movable item available in the Store which is the subject of the Sales Agreement between the Customer and the Seller;

Sale Agreement - a Product sales contract concluded or concluded between the Customer and the Seller via the Store;

Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827);

Act on the provision of electronic services - the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2013, item 1422 as amended);

Order - Customer's declaration of will submitted via the Order Form and aimed directly at concluding a Product Sales Agreement with the Seller.

GENERAL INFORMATION

1. The Store sells Products via the Internet. Information about the Products is published by the Store at http://www.babyuniverse.pl.

2. The range of the Store's operation covers only the territory of Poland. The Store does not sell or deliver Products outside the country.

3. All products available in the Store are brand new, free from physical and legal defects and have been legally placed on the Polish market.

4. Products may have a manufacturer's, importer's or seller's warranty, valid in Poland. Detailed conditions for the implementation of the guarantee are specified in the guarantee form issued by the guarantor.

5. Each ordered product is accompanied by a proof of purchase: a receipt or, at the Customer's request, a VAT invoice.

6. The information on the Store's website does not constitute an offer within the meaning of the Civil Code. By placing an Order using the mechanisms available on the Store's websites, the Customer submits an offer to buy a specific Product under the conditions specified in the Product description.

PLACING AND FULFILLMENT OF ORDERS

1. Orders from Customers are accepted via the website www.babyuniverse.pl (via the Order Form) 24 hours a day, 7 days a week. Placing orders via the Internet is possible provided that the ICT system used by the Customer meets the following minimum technical requirements: a) Internet browser with Java Script support: IE (minimum version 7) or Google Chrome (minimum version 13) or Mozilla Firefox (minimum version 10), b) Internet connection with minimum capacity: download 512 kbit / s, upload 128 kbit / s, c) active e-mail address.

2. Orders placed on weekdays after 12:00, on Saturdays, Sundays and public holidays are processed on the next working day.

3. The conclusion of the Sales Agreement takes place at the moment of confirming the acceptance of the Order for execution by the Store's staff. Confirmation of receipt of the Order and its acceptance for implementation takes place by sending the Customer an appropriate e-mail to the Customer's e-mail address provided when placing the Order, which contains at least the Seller's declaration of receipt of the Order and its acceptance for implementation and confirmation of the conclusion of the Sales Agreement. Upon receipt of the above e-mail by the Customer, a Sales Agreement is concluded between the Customer and the Seller.

4. The Sales Agreement is concluded in Polish.

5. The Sales Agreement is valid for each order, also "cash on delivery". Please see the consequences of not collecting such a package here.

CHANGES IN ORDERS

1. The Customer may make changes to the Order or cancel them until the Order is sent for shipment. Changes may be introduced by contacting the Customer Service Office by e-mail: sklep@babyuniverse.pl (preferred form of contact) or by phone: 796 845 195.

2. A registered customer may also cancel the order by logging in to the customer's account, entering the details of the order being processed and selecting the 'cancel order' button.

REFUND

If there is a need to return funds for a transaction made by the customer with a payment card, the seller will be refunded to the bank account assigned to the payment card of the Ordering Party.

PRICES

1. All Product prices are expressed in Polish zlotys and are gross prices (including VAT).

2. The prices listed next to the Products do not include information on shipping costs, because the information on the total value of the order is presented clearly and unambiguously after the Customer selects the form of delivery and payment. Before confirming the order, the Customer can check the delivery cost himself at https://www.babyuniverse.pl/en_GB/i/Time-and-delivery-costs.html.

3. The store does not use default options with hidden payments.

PAYMENT FORMS

The Customer can pay for the Order placed in the Store in the following way:

- cash on delivery - the amount is paid to the courier or postman,

- by bank transfer to the Store's account: ING Bank Śląski 91 1050 1520 1000 0092 7591 8002,

by electronic transfer, by payment card in one of the electronic payment systems (PayU, Braintree, PayPal).

DELIVERY

1. The ordered Products are delivered to the Customer via a courier company.

2. The decision on the form of delivery is made by the Customer when filling out the Order Form.

PROCESSING TIME

1. The processing  time is given for each offered product. This is the time that elapses from the confirmation of the Order (in the case of orders paid on delivery) or from the receipt of funds on our account (in the case of orders paid by bank transfer, electronic payment or payment card) until the ordered Products are sent from the Store, but only working days. An order for Products with different delivery times is sent after completing the whole, and the shipment date is determined on the basis of the Product with the longest delivery time.

2. Date of receipt of the shipment = order processing time + delivery time.

3. The delivery time depends on the choice of the company carrying out the delivery:

PRODUCT COMPLAINT

1. The Seller is obliged to provide the Customer with a Product without defects.

2. The basis and scope of the Seller's liability towards the Customer, if the sold Product has a physical or legal defect (warranty), are defined by generally applicable laws, in particular in the Civil Code. The liability under the warranty is excluded if the Customer is not a Consumer.

3. If the sold Goods have a defect, the Consumer has the right to:

a) submit a declaration of price reduction or withdrawal from the contract, unless the Seller immediately and without undue inconvenience to the Consumer replaces the defective product with a product free from defects or removes the defect. This limitation does not apply if the Product has already been replaced or repaired by the Seller or the Seller has not satisfied the obligation to replace the Product with a Product free from defects or to remove the defect.

b) demand replacement of the Product with a Product free from defects or removal of the defect. The Seller is obliged to replace the defective Product with a Product free from defects or to remove the defect within a reasonable time without undue inconvenience to the Customer.

4.The Consumer may, instead of the removal of the defect proposed by the Seller, demand the replacement of the Product with a product free from defects, or instead of replacing the Product, demand that the defect be removed, unless it is impossible to bring the Product into compliance with the contract in the manner chosen by the Consumer or would require excessive costs compared to the method proposed by the Consumer. The seller. When assessing the excess of costs, the value of the Product free from defects is taken into account, as well as the type and significance of the defect found, and the inconvenience to which the Consumer would otherwise be exposed.

5. The consumer may not withdraw from the contract if the defect of the Product is irrelevant.

6. It is recommended that the Product complaint should contain: (1) information and circumstances regarding the subject of the complaint, in particular the type and date of the defect; (2) a request for a method of bringing the Product into compliance with the Sales Agreement or a declaration of price reduction or withdrawal from the Sales Agreement; and (3) contact details of the person submitting the complaint - this will facilitate and speed up the consideration of the complaint by the Seller, although it is not a requirement to submit, consider or accept the complaint.

7. With regard to submitting complaints, the Consumer may use the complaint form provided by the Store, although it is not a requirement to submit, consider or recognize the complaint.

8. The complaint may be submitted in electronic form to the following address: sklep@babyuniverse.pl. Submitting a complaint in the above-mentioned manner will facilitate and accelerate the consideration of the complaint by the Seller, although it is not a requirement to submit, consider or accept the complaint.

9. The Seller will respond to the Consumer's complaint immediately, no later than within 14 calendar days from the date of its submission. Failure to respond to the Seller within the above-mentioned period means that the Seller considered the complaint justified.

10. If it will be necessary to deliver the Product to the Seller to respond by the Seller to the Consumer's complaint or to exercise the Consumer's rights under the warranty, the Consumer will be asked by the Seller to deliver the Product at the Seller's expense to the address MINDON Łukasz Kolanowski os. SECURITY AND PROTECTION OF PERSONAL DATA

1. Shopping at www.babyuniverse.pl is secured by an encrypted SSL connection. Personal data provided during ordering, registration and logging in are encrypted.

2. The administrator of personal data is MINDON Łukasz Kolanowski with its registered office at Teofila Mateckiego 22/23, 60-689 Poznań, entered into the Central Register and Information on Economic Activity kept by the minister competent for economy, NIP 9720951969, REGON 302430965.

3. Personal data collected by MINDON Łukasz Kolanowski via the Online Store are processed in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on free movement such data and repealing Directive 95/46 / EC (General Data Protection Regulation), also known as GDPR.

4. Providing personal data is voluntary, but the lack of consent to their processing makes it impossible to complete the order by the Store.

5. Each customer has the right to inspect their data, correct and update them, and request the cessation of their use at any time. 6. The data is processed in compliance with the security requirements specified in applicable law and is not made available to other entities for marketing purposes.

FINAL DECISIONS

1. In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular the Civil Code, the Act on the provision of electronic services, the Act on consumer rights.

2. Trademarks, product names and their photos are the sole property of their producers, they were used only for information and product presentation purposes.
